Not to hijack this thread to discuss rules or anything, but the distinction is important.
If there is only one ICE protecting the server, then you are right, it is the same. Whether the corp rezzes the ICE or not, the runner is going to skip it.
But if there are 3 or 4 ICE protecting a server, then it can become important. If the corp opts not to rez the first piece of ICE (or can't because it's a Tollbooth and he only has 7 credits), then that ICE was never encountered and Inside Job can still be used on the next piece of ICE that the corp rezzes since that would then be the first ICE encountered.
So saying that Inside Job 'bypasses an unrezzed piece of ICE' can be misleading. Last night I played and saw a runner run on a server with four ICE in front of it. First two were unrezzed (Tollbooth and Wall of Thorns). Third ICE was a rezzed Heimdall and the fourth was unrezzed (Enigma I think). Corp only had 7 credits.
Runner ran with Inside Job and corp could not afford to rez Tollbooth or Wall of Thorns, so the first ICE encountered was Heimdall, which was bypassed with Inside Job. Corp rezzed Enigma and the runner broke it easily and stole an agenda.
If we were 'bypassing an unrezzed piece of ICE', then the Inside Job would have bypassed the first Tollbooth, which the corp could not even afford and it would have been wasted.
Not that any of this is really important...I'm just bored.
